Blecher & Collins

Service Monopoly

Image Technical Services vs. Eastman Kodak Company

Blecher & Collins represented a group of independent service companies (ISOs) in an antitrust action against Eastman Kodak, a supplier and competitor in the high volume photocopier and micrographic equipment repair business. Kodak had stopped selling the ISOs needed replacement parts, thereby freezing them out of the market and creating a service monopoly. Blecher & Collins presented a compelling case and a San Francisco jury found that Kodak had violated Federal antitrust law. That finding has since been affirmed by the Ninth Circuit Court of Appeals.
